一些新建立的外貿(mào)公司，在經(jīng)營過程中總會遇到這樣或者那樣的問題，例如一些新建設(shè)的外貿(mào)公司在和對方簽署相關(guān)協(xié)議之后，沒有完成信用證操作流程，就開始涉及到發(fā)貨環(huán)節(jié)的相關(guān)問題，這會對公司的經(jīng)營帶來不利影響。
通常情況之下，國外企業(yè)都會按照如下流程展開合作：“The customer opens the letter of credit - - the letter of credit arrives at your bank, the bank gives you the letter of credit notice and the copy of the letter of credit, check to see if you can meet the requirements - - acceptance of production, arrange shipment”。因此我國外貿(mào)公司在和歐美等國家或是日韓等國家展開相應(yīng)的外貿(mào)合作時，都應(yīng)該按照如上的操作流程展開相應(yīng)工作，這樣的流程也是國際慣例，如果不按照這樣的流程展開相應(yīng)的工作，不僅可能對公司盈利造成負面影響，而且也會給對方企業(yè)留下不正規(guī)的印象，這對于后期業(yè)務(wù)展開而言無疑帶來絆腳石效應(yīng)。

We have learnt from your reply that you have already processed the L/C, but so far we have not received the L/C from your correspondent bank, nor any L/C notice from the bank you are negotiating. Please confirm again whether there is any deviation in the process of the L/C. To urge the dealer to contact the agreed bank in time and to urge the bank to issue the letter of credit notice in time.
After obtaining the letter of credit from the bank, we will arrange for the shipment on October 27 at Jinzhou Port. In accordance with the agreement previously negotiated, the land freight will be borne by us in the course of the shipment of this product, and the shipping charges and related insurance charges will be borne by you.

小型步進電機140臺，每臺75美元。
從貴方的回函中獲悉，貴方已經(jīng)辦理好信用證，不過我方到目前為止并沒有在相應(yīng)銀行收到貴方所辦理的信用證，也沒有接到貴方所洽談的這家銀行所給出的任何信用證通知書，請貴方再次確定信用證相關(guān)流程環(huán)節(jié)是否出現(xiàn)偏差，催促辦理方及時和所協(xié)議好的銀行取得聯(lián)系，督促銀行及時發(fā)出信用證通知書。
在獲得銀行信用證通知書后，我公司會在10月27日安排出貨，出貨港口為錦州港，按照此前所商談好的協(xié)定，在本次產(chǎn)品運輸過程中陸路運輸費由我方承擔，裝船費用及相關(guān)保險費用由貴方承擔。
如上的案例中涉及到兩方面的問題，首先是“You have already processed the L/C, but so far we have not received your L/C at the corresponding bank, nor have we received any notice of L/C from the bank you are negotiating.” 在回函過程中該企業(yè)明確的講到了不發(fā)貨的原因，主要因素是由對方造成的，所以在交易過程之中并沒有按照此前相關(guān)協(xié)商內(nèi)容及時組織發(fā)貨。
此后涉及“Please confirm again whether there is any deviation in the process of the letter of credit, urge the dealer to contact the agreed bank in time, and urge the bank to issue the letter of credit notice in time.” 可以看到這家公司的相關(guān)工作人員還是非常聰明的，該公司工作人員并沒有質(zhì)疑對方公司的資質(zhì)，也沒有否定對方并沒有及時辦理相關(guān)的信用證，只是督促對方第一時間進行信用證各流程環(huán)節(jié)的確定，避免出現(xiàn)問題，從對方的角度來看，這是一個善意的提醒，如果對方直到交易已經(jīng)進展到即將發(fā)貨的環(huán)節(jié)，依然沒有辦理信用證，明知這樣的做法違反合作協(xié)議，依然這樣去做，在獲悉交易方嚴格履行相關(guān)協(xié)議，不會有任何放水情況可能發(fā)生的狀態(tài)之下也會及時去辦理信用證，在這一交易過程中，如果對方企業(yè)不是一家惡意展開商貿(mào)往來的公司，很快就會將信用證發(fā)給賣方公司，賣方公司在回盤函中所提到的這些言論也不會讓對方公司產(chǎn)生任何誤解，所以貿(mào)易往來依然能夠繼續(xù)下去。如果對方公司是想要通過惡意貿(mào)易往來騙取銷售方的產(chǎn)品，在接到這樣的回函之后也就會知難而退，這樣能夠規(guī)避銷售方可能遇到的風(fēng)險。在和國外企業(yè)進行溝通過程之中，一定要關(guān)注到根據(jù)法律層面的相關(guān)協(xié)議方式展開交易，這樣才能夠確保自己的利益，而在措詞過程之中也要關(guān)注到如何給對方留有余地，避免即將達成的生意泡湯，對于這一點進行外貿(mào)工作的人員一定要謹記于心，這是能夠確保公司在外貿(mào)交易往來中獲得更多成功的關(guān)鍵所在。
